These Terms of Service govern the use of www.maisonvesaro.com and purchases made through the Maison Vesaro webshop.

Maison Vesaro is the trading name under which the webshop is operated by:

1. General

These Terms of Service apply to all offers, orders, purchases and agreements concluded through the Maison Vesaro webshop, unless mandatory applicable law provides otherwise.

By placing an order, the customer confirms that the information provided is accurate and complete.

The customer is responsible for reviewing the order before completing the purchase.

2. Information on the Website

Maison Vesaro takes reasonable care to ensure that information displayed on the website is accurate and current.

However, minor differences may occur between website representations and physical products.

This may include differences in:

colour;
appearance;
measurements;
texture;
photography;
screen representation.

Such differences do not automatically constitute a defect or non-conformity.

3. Product Availability

All products are subject to availability.

A product being displayed on the website does not guarantee that the product will remain available until an order has been successfully processed.

If an ordered product becomes unavailable, Maison Vesaro may notify the customer and refund any amount paid for the unavailable product where required.

4. Obvious Errors

Maison Vesaro reserves the right to correct obvious typographical, pricing, technical or product-information errors.

If an order has been placed based on an obvious error that a reasonable customer should have recognised as such, Maison Vesaro may cancel the affected order to the extent permitted by law.

If payment has already been received, the relevant amount will be refunded where legally required.

5. Prices

All prices are displayed in euros unless otherwise stated.

Prices and offers may change at any time before an order is placed.

The price applicable to a validly concluded purchase will generally be the price displayed at the time the order is placed, subject to correction of obvious errors and applicable law.

Shipping costs are displayed separately where applicable.

6. Orders

An order constitutes an offer by the customer to purchase the selected products.

Maison Vesaro reserves the right to refuse or cancel an order, to the extent permitted by law, including where there is:

suspected fraud;
suspected payment abuse;
an obvious pricing error;
an obvious technical error;
product unavailability;
an inability to deliver to the provided address;
suspected misuse of promotions;
other legitimate reasons permitted by applicable law.

If an order is cancelled after payment, the amount that must legally be refunded will be refunded.

7. Payment

The customer must provide accurate payment information and must be authorised to use the selected payment method.

Orders may be processed after successful payment confirmation.

If payment fails, is reversed, charged back or otherwise remains unpaid, Maison Vesaro may suspend processing of the order and take lawful steps to recover amounts due.

8. Delivery

Maison Vesaro currently delivers within the Netherlands.

The standard estimated delivery period is 1–5 business days, unless another period is specifically communicated for the relevant product.

Delivery estimates may be affected by circumstances beyond Maison Vesaro's reasonable control.

9. Customer Delivery Information

The customer is responsible for providing accurate and complete delivery information.

This includes:

full name;
street and house number;
postal code;
city;
any additional information reasonably required for delivery.

Maison Vesaro is not responsible for delays, failed deliveries or additional costs caused by inaccurate or incomplete information supplied by the customer, to the extent permitted by law.

10. Shipping Carriers

Maison Vesaro may use third-party carriers and logistics providers.

Tracking information, where available, is provided for convenience.

Maison Vesaro may reasonably cooperate with the carrier to investigate delivery issues.

11. Risk

For consumer purchases, risk in the product passes to the consumer when the consumer or a third party designated by the consumer, other than the carrier, obtains physical possession of the product, in accordance with applicable law.

12. Right of Withdrawal

Consumers have the statutory right of withdrawal applicable to distance purchases.

Maison Vesaro provides the legally required withdrawal information and online withdrawal function.

The statutory right of withdrawal is not a voluntary service and cannot be waived by the customer through these Terms.

13. Returns

Returns are governed by the Maison Vesaro Return & Refund Policy.

The customer remains responsible for complying with the applicable return procedure and deadlines.

Nothing in these Terms limits mandatory statutory rights.

14. Legal Guarantee and Conformity

Maison Vesaro does not exclude or restrict mandatory statutory rights relating to conformity, defects or legal guarantees.

If a product does not conform to the agreement, Maison Vesaro will assess the complaint and provide the remedy required under applicable law.

Depending on the circumstances, legally available remedies may include repair, replacement, price reduction or termination of the agreement.

15. Product Care

Customers are responsible for following reasonable care and usage instructions supplied with products.

Maison Vesaro cannot be held responsible, to the extent permitted by law, for damage caused by:

improper washing;
improper drying;
improper ironing;
improper storage;
misuse;
unauthorised alterations;
improper handling;
use contrary to supplied care instructions.

This does not affect statutory rights concerning defects that existed independently of such misuse.

16. Intellectual Property

All intellectual property relating to Maison Vesaro, including:

brand names;
logos;
photographs;
product photography;
website designs;
graphics;
texts;
layouts;
original marketing materials;

is owned by or licensed to Arti Solutions / Maison Vesaro unless otherwise stated.

Unauthorised copying, reproduction, distribution, modification or commercial use is prohibited to the extent permitted by law.

17. Website Use

Customers may use the website only for lawful purposes.

Customers must not:

interfere with website operation;
attempt unauthorised access;
introduce malicious code;
misuse website functionality;
use automated systems to abuse the website;
attempt to circumvent security measures.

Maison Vesaro may take appropriate lawful measures against misuse.

18. Website Availability

Maison Vesaro aims to maintain a functioning webshop but does not guarantee uninterrupted or error-free availability.

The website may occasionally be unavailable due to:

maintenance;
updates;
technical issues;
hosting problems;
security incidents;
infrastructure failures;
circumstances outside Maison Vesaro's reasonable control.

19. Force Majeure

Maison Vesaro is not responsible for failure or delay caused by circumstances beyond its reasonable control, to the extent permitted by law.

natural disasters;
extreme weather;
strikes;
transport disruptions;
supplier disruptions;
shortages;
cyber incidents;
government measures;
war;
civil unrest;
infrastructure failures;
widespread technical failures.

Maison Vesaro will make reasonable efforts to minimise the consequences.

20. Fraud and Abuse

Maison Vesaro may investigate suspected fraudulent or abusive behaviour.

This includes suspected:

payment fraud;
identity misuse;
promotional abuse;
return fraud;
false defect claims;
repeated abusive ordering;
attempts to exploit technical or pricing errors.

Maison Vesaro may take appropriate lawful action where reasonably necessary.

21. Limitation of Liability

To the maximum extent permitted by applicable law, Maison Vesaro shall not be liable for indirect, incidental, special or consequential losses arising from the use of the website or products.

Maison Vesaro does not exclude liability where such exclusion is prohibited by mandatory law.

Nothing in these Terms limits or excludes liability for matters that cannot legally be limited or excluded.

For consumers, mandatory statutory rights always prevail.

22. Third-Party Services

The website may rely on third-party services, including payment processors, hosting providers, carriers, analytics providers and other service providers.

Maison Vesaro is not responsible for independent failures of third-party services to the extent that such responsibility cannot legally be attributed to Maison Vesaro.

This does not affect statutory consumer rights concerning the purchase agreement.

23. Complaints

Customers should contact Maison Vesaro as soon as reasonably possible when they have a complaint.

Maison Vesaro will make reasonable efforts to handle complaints promptly.

24. Changes to These Terms

The version applicable to a particular purchase is generally the version applicable when that purchase was concluded, subject to mandatory law.

25. Severability

If any provision of these Terms is found to be invalid, unenforceable or contrary to mandatory law, that provision shall be interpreted or limited to the minimum extent necessary.

The remaining provisions shall remain effective to the extent permitted by law.

This provision does not seek to deprive consumers of any mandatory rights.
